These terms govern use of the Peak Pay website. By using the site, you agree to these terms. Product-specific applications, agreements, provider terms, program guides, and disclosures control if they conflict with this page.
1. Informational website
Website content is provided for general informational and marketing purposes. It is not legal, tax, accounting, investment, or financial advice. Product features, availability, pricing, equipment, processing terms, commissions, residuals, approval criteria, and timelines may change and may vary by provider, business, industry, jurisdiction, and agreement.
2. Merchant services
Payment processing and merchant services are subject to underwriting, processor or acquiring-bank approval, applicable agreements, prohibited-business rules, card-brand rules, PCI requirements, pricing, and other conditions. Peak Pay does not guarantee approval, uninterrupted processing, savings, equipment eligibility, or specific transaction outcomes.
3. Dual Pricing, cash discount, and surcharge programs
Programs must be configured and operated according to applicable federal, state, and local law; card-brand rules; processor requirements; signage and disclosure requirements; receipt requirements; pricing caps; debit-card rules; and other applicable conditions. Terminology and requirements differ among dual-pricing, cash-discount, service-fee, and surcharge models. Merchants are responsible for operating the selected program compliantly. Examples on this site are illustrative and do not constitute legal advice or a guarantee of savings.
4. Free equipment and promotions
Free equipment, credits, rebates, promotions, or switching incentives are available only to qualifying merchants and may require processing approval, an agreement, minimum activity, return conditions, or other terms. Taxes, shipping, accessories, software, installation, replacement, and early-termination obligations may apply.
5. Business financing
Peak Pay is not a bank or lender and does not make credit decisions. Business financing is provided by participating third-party providers and is subject to application, verification, approval, availability, provider terms, and applicable law. Amounts, rates or factor costs, fees, payment frequency, term, collateral or guarantee requirements, and funding timing vary. No offer or funding is guaranteed. Carefully review all agreements and disclosures before acceptance.
6. Consumer and customer financing
Peak Pay does not originate consumer credit. Credit products and lending decisions are made by participating providers. Pre-qualification may involve a soft credit inquiry where stated by the provider; accepting an offer or completing later steps may involve additional verification or a hard inquiry. Availability, approval, amounts, rates, fees, repayment terms, and funding timing are determined by the provider.
7. POS, software, and third-party products
POWR POS, Clover, SimplyGiv, Ottri, and other third-party products are subject to their respective agreements, pricing, privacy policies, support terms, technical requirements, and availability. Features and integrations may change. Third-party marks are the property of their respective owners and are used for identification.
8. Partner programs
Partner eligibility, commissions, bonuses, residuals, Schedule A terms, ownership, vesting, payment timing, chargebacks, reserves, clawbacks, merchant assignment, white-label availability, and termination rights are governed solely by signed partner agreements. Website statements are not an offer or guarantee of compensation.
9. Forms and communications
By submitting a form, you authorize Peak Pay to contact you about your inquiry and related products or services. Do not submit sensitive financial, banking, identity, medical, or payment-card information through a general contact form or ordinary email.
10. Website availability and prohibited use
You may not misuse the site, attempt unauthorized access, introduce malicious code, scrape the site in violation of law, impersonate others, or use the site for unlawful activity. We may change, suspend, or discontinue any site feature.
11. No warranties
The site is provided “as is” and “as available” to the maximum extent permitted by law. Peak Pay disclaims warranties not expressly stated in a signed agreement.
12. Limitation of liability
To the maximum extent permitted by law, Peak Pay will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the site or reliance on its content. Some jurisdictions do not permit certain limitations, so they may not apply to you.
13. Governing law
Unless a signed agreement states otherwise, these website terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
